I am currently on H1B visa, and would like to apply for EB1C.
I moved to the US on 2009 using L1B, then switches to H1B on Nov 2011.
When I was outside the US, I worked for the same company in a senior position, I managed two people in 2007-2008 (for more than a year), I also used to manage a "function" in the company.
But while I am in the US, there was no people to report to me, even though I continued to manage some "functions" in the company.
1. Can somebody apply for EB1C, relying on his managerial job outside the US, even though his current position in the company is not managerial?
2. If the answer for #1 is negative, can I claim managerial position in the proposed position (i.e. in the job description for the GC).
3. What's the definition of "functional management", can I claim functional management even if there was nobody reporting to me in the US.
