L1 RFE and H1 conversion
Hi All,
My current visa L1 Blanket is getting expired by sep 06 2013, i also applied by H1B conversion through the same employer and yet to get a response. Yesterday i received RFE for my L1 petition, i have few queries, please find the same below.
1. I have filed my H1 as well, and it was picked in the lottery, i am currently waiting for the response from USCIS, if i respond to L1 RFE now and if the RFE got approved after i got my H1 approval what will happen? will i stay in H1 or L1?
2. If i got my H1 approved and if L1 RFE was denied, what will be the case? will i continue as a H1 or i need to go back to India?
3. My wife will enter in her 9th month of pregnancy by next month, at that time it is highly unlikely for us to travel back to india for another 2-3 months , If L1 RFE is in progress and if i get my H1 approved is there any possible way to revoke/cancel my RFE?
4. What is the maximum time allowed to respond to RFE? my Visa & I94 is expiring by Sep 06 2013
