    Hello All,

    I had H1B visa and was expired on 22-Sep-2011. During my visa validity i did not stepped in to US due to some reasons. So now is there any way that I can renew my expired H1B visa.

    Hello, Kimpurusha.

    If you were issued H1B, you can renew it. It is valid for 6 years. You will need a fresh petition.

      thanks for the info. i have few more question like:

      1) Will I come under H1B Cap Exempt?
      2) If at all i get visa then what would be the validity?

      please let me know if you need more details.

        1) You are cap exempt. If you were on H1B status for sometime in the last 6 years, you can recapture this. And, you are cap exempt. If you have not used the H1B at all but did get picked up in the draw, you can revive it within 6 years from the time of issue.

        2) If you are able to revive it: a) You are entitled to use whatever is the remaining unused period on your H1B. If you have not used the H1B, at all, you are entitled to the whole of 6 years, b) Your petition, filed by employer decides what duration you get. You can get maximum 3 years, in one go. Your employer has to seek a 3 year visa on the petition. You can also be given shorter duration visas, i.e.: 1 year, 6 months. I have even heard of 3 month H1Bs. So, all depends on your petition.
