I am on H4 VISA currently. I have an approved H1B petition. My employer is planning to file for a change of status from H4 to H1.
My spouse should leave USA in 10 days. My employer is telling me that if my COS is filed and i got receipt number then am good to stay even if my spouse leave USA.
Note : My H4 will expire ing to expire in One month.
1. Can i stay with just receipt number while my spouse who is the H1 holder is not in USA with me?
2. If i stay that way and my COS is denied what would be my status called for the period i stayed without my spouse?
3. Will i face any issues in future when i apply for VISA?
4. will my spouse be affected in any way? if yes, in what way?
