Hi, I have query. My husband is presently working with company A in L1 visa. He had filed H1 visa with company B for the first time and that visa is approved which would be active from Oct1. Company B is acquired by some other company. Now we are worried what can be done to save our visa. 1) we thought of H1 transfer but we got information that we cannot transfer H1 B visa as this is the first time we have applied for H1 and there are no pay stubs from company B. 2) we thought to revoke H1 visa as company B assured that this would be active till 3 years and once company B gets a project he would again apply for our h1 B visa but again we came to know since H1 revoke would happen before its activation so again my husband would have to apply as new candidate and has to enter the Cap run. 3) Another company C is ready to transfer our visa stating that u can stay with company B , and work for company C client get 2 pay stubs from company B and then company C would transfer H1 visa from B to C.
We are really confused what can be done. Need a way out to save H1 visa. Kindly suggest
