  • Upcoming travel: H1B visa stamping and departure from the US

    Hello,

    Here's my background.
Arrived in the US in July 2010 on F1 visa. Graduated in May 2012.
Employer filed H1B visa this year and I'm eligible to work on H1B from Oct 1, 2013.
I have never traveled out of the US since July 2012.

I have two I-94s (first one of F1 Visa and the new one of h1B via).

I plan to go to my home country in next week so do I need to give both the I-94s or just one (if, yes, then which one?)

    Thanks.

You have to hand over both the I94 and go for new H1 visa stamping in order to come back on H1.

This is my opinion not legal advice.

It does not matter which I-94 you hand over. Are you returning before Oct 1 or after? Do you have OPT?

Yes, I'll come back to the US Oct 12. I'll get my H1B visa stamped before I return to the US.
Until Oct 1, I'll be on OPT.
