H1B Extension filing, Can my employer use the same LCA since Govt is Shutdown

Hello,

Any help would be highly appreciated.

My H1-B visa is expiring on 25th October 2013 and am not sure if my employer has submitted my case with DOL department to obtain the certified LCA. However my current LCA that I have is valid till October 2015, So in this case due to government shutdown can my employer use the current LCA to file my case with USCIS (Just in case if my employer has filed and not received my current certified LCA from DOL)

I am also in the similar position. My H1B also expires on 25th Oct 2013.

My employer is not able to file the petition because of the pending LCA and exploring the possiblity of the filing with out LCA.

I am also in a similar situation, my H1b, I94 both expiring on 10/31. LCA was applied on 10/18 after dol resumed operation. What are my options? Do I have to leave the country if I do not get the LCA certified by 10/31? What are my options. My attorney says, I can be in US for 30 days after H1B expiring, is that true?
