H1-B validity..

Hi All,
I was on a H1-B visa in USA that had validity until Sept 2014. But I left my employer in US and relocated to Singapore. However, i am planning to return back to US. So my question is regarding the validity of my H1-B visa ?does the company need to start the H1-B process from scratch ? I am planning to start with the same company for which I was sponsored the H1-B visa (and they had actually filed my GC as well in EB3 category priority date Aug 2007)..please let me know if anyone has inputs around this..also i had been in US for 10 years with valid SSN and have filed taxes..now if i return back i need to file for a new SSN ??

How much time did you spend in USA on H1B visa? And, for long have you been out of USA?

Hi, I have been on H1-B visa since 2005, it was already renewed 2 times and date of expiry is Sept 2014.. I have been out of USA for about a year now (I left for SG in Sept 2012)..

Sam,

As your GC has been filed, i am sorry, i am not aware of whether you should use your old visa or a fresh one. Good thing you have already stayed outside for a year, so you could file a petition and it could be considered a fresh petition. But as your GC is filed (i am guessing Labour approved by now) i am not exactly aware. I am sorry.

Thanks for your response. Yes, my LC was already approved and my EB3 priority date was in Aug 2007...With my H1-B having an expiry of Sept 2014 (same for my spouse H4 expiry date Sept 2014), I think it will be much more easy process if the same employer can refile (without having to start the process from scratch)..i am thinking my GC process must already have stopped the day i quit my employer and left US.....but as you mentioned, not sure on this..so waiting for reply...
