  • L1 to H1 COS

    Hello,

I am currently working for an employer A on L1B and an employer B filed a H1B in 2013 quota. Employer B filed H1 along with COS. Due to some emergency reasons I travelled to India in April 2013 when my H1 and COS are still pending and returned on L1. Today(oct 10th) I heard from USCIS that my H1 is approved.

    Questions:

    1. Based on my research my COS should have been abandoned when I travelled to India? Is this true?
    2. I haven't got my documents yet, but, will I get a new i94 along with my documents? If yes, per last action rule my status is controlled by this i94?
    3. How do I make sure which status I am on right now?
    4. If my COS was abandoned due to my travel in April, can I file a COS now without traveling outside country to have the visa stamped?

    Appreciate your response.

      Hello, Kinnu.

As you returned to US before your H1 decision could be taken, i feel your COS is not abandoned. Please wait for the documents.

      Personal Opinion.

      Wishing you luck.

      Cheers,
These are my personal thoughts. I am not a professional.

      Wishing you luck.
