H1B RFE USCIS want to directly contact client

Need help!!!

RFE is about client and project information. My employer has submitted client letter and valid contract. But USCIS is saying they want to talk to the client directly and want more project details…This year USCIS is very strict. They want every minute detail. My education and previous employment docs are fine, no issues on that. Has anybody got such RFE?? How to respond?? My issue is employer get scared whenever there’s a RFE and ask me to void application and retry next year….please suggest something!!!

I heard of a recent case where the consulate actually emailed the end client and asked them to explain how a particular candidate's skill-set helped in the job applied / sponsored for. The end client responded to the email from the consulate and explained the candidate's background and the job requirement, post which the visa was issued.

Your case seems to be similar.

I was hired for Client A to join on 1st Oct but due to two RFE's in my case, it is getting delayed and delayed. Now client A does not want me anymore. He has replaced me. And in this RFE we have to give his contact number. Now my employer want to void my petition and is asking me to retry next year. According to case mentioned by you USCIS is actually going to contact them. Is there any way? Should I start searching for another client? Will any company hire me at this point?

Sorry to hear about the delay in your case.

Has your I797 been approved? Or this RFE is I797? If your I797 has been approved, then you can actually find another employer and move your visa to him. You will get a fresh I797, you go for stamping on that I797 and carry on with your life.

Do not worry about this delay impacting your visa sponsorship. I know it is very frustrating having your visa stalled like this and not being able to work in the US. But, no one will judge you because your visa got delayed or even denied (i hope it does not denied). If it does get denied, find another employer and try again.

Just one more query. I think i got NOID. Can I reapply with some other employer same denied petition this year in cap exempt? As my current employer is not replying to RFE.

Hello, Sarita.

If this RFE was post application getting picked up in the H1B draw then yes, you can reapply. i.e.: RFE came for something like Change of Status.

If this was pre-application, then i feel you do not have an H1B yet.

Please can you clarify.
