I need to understand under what all circumstances does an H1B applicant/H1B transfer applicant receive I-797B from USCIS. Through internet research, I understood two circumstances in which one would get I-797B for H1B approval:
1. If you are in a country other than US, so you need to get visa stamped before entering US
2. If you are currently residing in US and 'have not been able to maintain H1B status', so you need to go back to home country to get visa stamped before re-entering US and joining the company with which you transferred H1B visa
Are there any other circumstances in which you can get I-797B while you are currently residing in US? I will greatly appreciate if someone can enlighten me on this topic. Thank you in advance.
