h1b expires in 10 days

Hi,

I am currently on an H1B visa. My visa expires Oct 23rd 2013. My employer is waiting to file my petition due to LCA shutdown.

What should i do if my petition not filed before 23rd?
Is there any chance to file my petition without LCA?
Do I get any grace period to stay in US to file my petition?
