Hi all,
I have a question related to H1 transfer, H4 and India visit.
Me and my wife's passport both have an expired visa stamp (of Company A) on passports. My visa is of type H1B and my wife's is of type H4.
I have H1B(I-797) valid till Jan 2015 for Company B. My wife has H4 visa (I797) valid till the same time.
She is currently in India and I am thinking of job switch to Company C.
Company C is about to file H1 transfer for me this week and under premium processing, hopefully I should get everything in about 3-4 weeks.
They are saying that they cannot do the H4 transfer for my wife since she is not in US currently. Is this correct?
I have to visit India soon(end of Nov) and when I am there I have to go for visa stamping(along with my wife) at the consulate since my current visa stamp on passport has expired. I will be carrying I-797 of company C while going for the interview.
My question is that could there be any problem with my wife's H4 stamping, since for her there was no H4 transfer done and she doesn't have a new I-797?
