Travelling to India for H1B stamping with only 7 month valid I-797

  • Travelling to India for H1B stamping with only 7 month valid I-797

    Dear all,

    I am planning a India trip in Feb'14 and my I-797 expires on Oct'14. I am going for a H1B stamping since my previous visa was expired.

    1) Will there be any difficulties in visa interview since i have only 7 month valid I-797
    2) I am planning to return back on Mar'14 (1 month vacation). Will there be any issue at port of entry?

    PS: I can extend my I-797 for 3 years based on my I-140 approval after Oct'14.

    Need your guidance on this. Please help.

    There should not be challenges. People some times get 6 months I797, some times even less. Same, for the Port of Entry. No issues.

        I am in similar situation and would have around 6 months left on my I-797. Did you had any issue either during the stamping or Port of Entry? Your experience will really help
