  • L1B to H1B transfer...how long can i continue working on L1B

    Hi,

    My L1B got extended this year in July. While my L1 extension was in process , I also applied for H1B visa through an external contractor A.

    I got RFE on my H1B petition, but it was approved on 8th Oct.

    I have been made aware that my H1B petition was applied as change of status.

    As I'm searching for project on H1, please let me know how long can I continue working on L1B visa.

    Also, can I change the status back to L1, in case if I want to. If not, what is my best option to stick to L1B company in US , if in future I dont want to work for contractor A.

    Answer is zero days. As soon as H1 COS date is active any employment with L1 employer is illegal. So if H1 was active from 08-Oct-2013 but you still working with L1 employer, it basically means you are out of status.

    What do you mean searching for project? Wasnt a project/client available when the H1 petition was filed in the first place? On what basis did the H1 employer file the petition then?

    Changing status is no child's play and one should determine all pros and cons before filing for one.

    To change status back to L1 you will have to leave US and return on a valid L1 visa.
