h1b transfer with just the approved peition number

Hi,

I'm in US on h1b visa and my wife on h4. She has her h1b petition approved filed an employer and now the employer does not want to give the originial/copy of i797.
Can she try for h1b transfer with the approved h1b petition number or will that get into any complications/problems?
