  • New I-94 due to travel on F1 OPT. Do I need to get H1B stamping?

    Hi,

I'm in a very confused state for the past few days and I would appreciate any help.

    Here is my case:
I did my MBA in the US and was working in my F1 OPT and got my H1B approved.
I had to travel to India in the month of July due to a family emergency and returned back in my F1 OPT status. Now I have a new I-94 number and it has admission until date as F1 D/s, when I checked online.
My OPT was valid until August 19,2013 and I re-entered in the month of July. Hence, I went to my school to get my cap-gap extension OPT so that I can continue working till September 30 before my H1B takes over from October 1st.
My school told me that I don't need to get stamped till I leave the country and my cap-gap I-20 as has the H1B EAC number printed on it.

Now, my confusion is my I-94 says it expires with my F1 D/s, which was September 30. Will my H1B take over automatically or do I need to get stamping immediately?

Please any guidance will be on immense help and save me from sleepless nights.

    Thanks,
    Sundar

    Hello, Sundar.

With the H1B approval, you would have received an I94 as well (at the bottom). What is the date on that?

    Cheers,
These are my personal thoughts. I am not a professional.

    Wishing you luck.
