I am an Indian citizen living in the US with a H1B visa. I moved to the US 11 years ago as a graduate student and still have 3 years on my H1B visa. I am getting married this winter and my fiancee is also an Indian citizen. She had applied for a visitors visa a couple of years back when we were dating and was rejected on the basis that she may not return to India after coming to the US. Now that we are getting married, I would like to know what is the risk during the visa application process for her, i.e., if she applies for a dependent visa, will she be rejected on the basis that she was rejected earlier?
Another related enquiry: I would like to apply for Green card in 2014 and I want to add my fiancee to my green card (she will be married by then). Does she have to be in the US to be on my green card application?
