H1B Transfer when current I -94 has expired

My current I - 94 with present employer A has expired.
Though my status is valid to continue to work as my H1-B extension with employer A is in progress, awaiting an approval.


My question is :

I have received a new offer from am employer B. Can I switch to the employer B with an expired I-94 and an extension applied only ( not yet approved ) with employer A?

Hello, USA2013.

I think you can switch to Employer B. But, for successful transfer to B, your earlier extension petition has to get approved. As your legal status in USA is based on that extension petition, that needs to get approved first.
