  • Regarding H1B Renual

    Hi,

    I got my H1B visa stamped in March-2001. I visited to USA twice to work but unfortunately My projects were cancel due to 9/11 and war incidents. During my visit, I never had been on payroll for a single day. And my stay in USA was around 16 months. Now at present I am in USA with different visa. So, Please clear my following doubts.

    1. I want to work in USA. Can I do so?

    2. Can I utilized my previous H1B visa?

    3. Should I come under the 65K CAP or not while filing for the H1?

    4. Can I utilized my work permit which I never used for USA?

    Hello, VGU.

    For someone to revive and old H1B, that person is required to have maintained H1B status for some time in the past 6 years. From the date of issue of your visa, it looks unlikely that you were on active H1B in the past 6 years.


    i) Depending on the visa you are on right now, you could file for another H1B
    ii) You will have to be counted in the cap of 65K (If you are not able to use your old H1B)
    iii) What work permit are you referring to? Please elaborate.

    Also, what visa are you on at present?

      I didn't get your point for the active h1b in the past 6 years. How can i get my h1b visa now?

      Please explain.
