I had a H1B visa which was valid until August 2011 and when i went for stamping in Mumbai in Dec 2010 the VO handed me a 221(g) form and asked several documents which I submitted. In April 2011, I received a letter from USCIS that the case is under review and they had sent my passport back to me. After few months I had received a letter that since my visa is now expired I can file a petition to revoke it. Now my question is,
Can an employer revoke the same petition since I had some 16 months remaining?
If an employer wish to sponsor me a H1B visa, is there a condition that I don't fall under the cap of 65000 limit since I already lived and worked in the US on H1B?
I would appreciate a response to this thread. Please let me know if there is any clarification required on my case.
