  • H1B Transfer/Extension Case

    Hi,

    I transfered to a new company on Sep 1st and my H1B Exp date was on Sep 30, 2013. My new employer applied for an extension/Transfer (Regular Process)on Aug 29th, 2013. Till date I dont see update on the status (Initial Review). I just wanted to understand how long I can work when with Reciept Notice? Any others issues may take place as my old H1B is expired and I94 as well.

    I am planning for premium process as well. Will there be any issues in such case?

    Please suggest me.

    Technically you should not work only on the receipt notice. The biggest risk is if the transfer is rejected you go out of status, and if I-94 expired as well you become illegal too.

      To correct the above, technically you can work on the receipt notice. But the risk is correctly noted.

          Yes you can do so by filing I-907. There is a cost associated with it too $1225. I believe you can e-file too.
