My wife and I are scheduled to travel to India in less than 3 weeks. But my employer still haven't received an approved petition on my H1B extension application, which is now outside of the service center's processing time. I do have a current approved H1B petition that is valid until Feb 10th, 2014 . We need to make an appointment for our visa stamping interview at the US consulate office in India for January 2nd now, before the appointment date gets fully booked. Can we make the appointment using my existing H1B petition that will expire on Feb 10th 2014, and if, in the meantime, we receive the new approved petition, take it to the interview appointment and get stamping based on the I-94 expiration date on the new petition? If we don't get the new petition by the interview date, can we still get visa stamping until Feb 10th 2014, and re-enter the US with that visa? Any advice would be greatly appreciated.
