I work for a non- profit research organisation. But my employer is unable to sponsor my H1B. So they are trying to get me in, as a contract employee (thro' a staffing agency) to work for them. Looks like this staffing agency will apply for my work visa a year later.
My question here is: I know very well that my employer being a non-profit organisation is H1B cap-exempt and I get to have the advantage of filing H1 anytime and goes thro' a special track. But what happens when I work for the same research lab as a contract employee via staffing agency? Will I still have the advantage of cap-exemption?
