Hi,
I was working in L1 visa and my wife was working in L2 EAD. We both applied for H1B on this year with COS.
My H1B was approved on Oct 15 2013 after an RFE. But my wife's H1B petition is still RFE even 60 days after her employer responded to RFE on Education Transcription.
We doubt the delay in my wife H1B approval is due to
1. Since my visa status has got changed from L1 to H1 and her L2 status has become invalid
2. (or) Our I94 on L visa has got expired as of Nov 2 2013.
Note: We have also filled H4 for my wife by Oct 28 2013 before I-94 expiry, once my H1B is approved.
My question here is,
Is my assumption is correct ?
and Do we need to do any action from our end to confirm we are still inside the country.
