Thanks for the respone.
My issue is below;

1 Company A filed H1 in 2007 got approval and didnt use that at all.
2 company B transferred the h1 which was filed in 2007. Got approval for I-797 from match 2008 to oct 2011.

Went to visa with this new I-797 which was valid from march to oct got 221g. Employer didnt respond it .

Now I am in USA on l1 b. can I use this h1 under cap- exempt. Please advice .
