  • H1b: Query in DS 160 form

    Hi,
I have a query when filling DS 160 form for H1b stamping. There is a question “Have you ever been unlawfully present, overstayed the amount of time granted by an immigration official or otherwise violated the terms of a U.S. visa?”. My case is:

I was in the US in 2012 on L1b. My L1b extension was rejected when I was in the US and I returned to home country. The denial status was updated in USCIS.gov on 5Oct2012. My company may have received the denial notice in 2-3 days. I left the US on 14Oct2012 as I had to close down all my things (Apt lease, had to sell my Car etc). I am marking the question as "Yes". Pls let me know what is the reason to provide? Is there any chance for rejection during Stamping?
    L1b Visa & I94 expiry:16Aug12
    Extn applied:01Jun12
    Extn denied:5Oct12
    Left US:14Oct12

Kindly respond to the below questions:
    1) Should I mention the exact number of days (9days) that I overstayed after getting to know the denial status?
    2) Is this scenario considered as an Overstay by USCIS?
    3) Can I provide the same reason provided above (that is, had to close down all my things) for the Question in DS160?
    4) Is there any chance for rejection due to this?

    Thanks for the help.
