My fiance and I are getting married in April 2014, his H1B is expiring on August 1st, 2014. I have a few questions, His company is filing an expedited extension in Feb 2014, owing to which he will get his extension confirmation only by March 2014.
1) If I am applying for an H4 now is it OK to enter his old petition no on the DS 160 ? and once the extension come through take both the I-797's for the VISA interview and explain my case to the visa officer - Is this advisable ?
2) 2nd option - wait till his extension comes through, use the latest petition number and then file an extension - the risk I see here is I may not get the Visa interview date that I want
Kindly advice which would be the safest way
