Dropbox waiver with different petitioner

Am I eligible for Dropbox program if my petitioner is different.

My use case:

I was on H1-B with Company A and my visa stamp was valid till Sept. 2013. I joined a company B now, and I am planning to visit India, and since my visa is expired, I need to get a new stamp. I was wondering if I am still eligible to be in "Dropbox Waiver" program. (I am applying for same class Visa (H1-b)).

No you are not.


If I am applying for an H or L (individual) visa, my prior visa in the same classification with the same petitioner is still valid or expired within the last 12 months....
