H4 with SSN

    Hi

    My wife was in US on H1b from Oct 2007 and worked here till Jan 2008
    She got a SSN while she working here. She went back to India in Jan 2008

    Now after 6 years she came back with me on H4 on Dec 2013
    Her H1b has expired now

    1. Is her SSN still valid (for taxation purposes / bank accounts etc)?
    2. can i file tax jointly with her SSN or should i apply for a ITIN for her?
    3. if she wants to work again here, can she apply for COS to H1

    An SSN once allotted is valid ever after.
    1. Yes.
    2. Yes you can use SSN. Anyhow I dont think ITIN is allotted for people already holding SSN.
    3. Possible, but I guess one needs to be in H1 status in last 6 Years so if she was on H1 in 2008 she may have time only till Jan 2014, talk to an attorney to determine the feasibility.
