    Hello,

    My current H1B status expires in July, 2014. My employer ( a non-profit organization) is willing to file for a 3-year extension. My initial H1B application was done by a lawyer, but this time, my emplyer wants to file without a lawyer. So I need to inform my emplyer as well as I can of the required documents.

    Thank you in advance for your time and comments.

    It seems that after reading online, steps for applying for an extension is similar to the initial petition, but I want to make sure if I am understanding this correctly.

    1) Does my employer need to file for another labor condition ETA form 9035 and 9035E? The current one expires in July, 2014.

    2) Does my employer submit a duplicate copy of all of the required documents because this is an application for a H1B extension?

    3) My employer has less than 50 employees. Does this mean that the fee is only the base line $325 without fraud prevention fees and other fees?

    4) I-140 filed by the same emplyer is pending at this moment. How does this affect the H1B extension?

    5) I made a list of all of the required documents. Does it seem correct?

    From the employer
    • Duplicate copies of form I-129
    • Copy of the job offer letter containing the job title, salary offered, signed by both employer and foreign national
    • Detailed job description
    • Company brochure / any marketing material
    • Copy of most recent financial statement, annual report
    • Copy of articles of incorporation
    • ?Non refundable fee of $325 – basic fees – any additional fees?
    • Pending immigration petition?

    From the foreign national
    • Copies of all U.S. visas, I-94’s and I-797 (employment petition) approval notice
    • Copies of transcripts from university degrees
    • Copies of letters of experience from previous employers, if available
    • Copy of resume
    • Copy of 3 most recent paychecks, W-2s
    • Copies of current passport valid for at least 6 month, containing all the visas.
    • For spouse, certified copies of the principals visa, valid i-94 (front and back) in addition to all other required documents for H4.
