  • H1B extension after resigning the job and leaving US

    Hi,
I was working in US with H1B Visa which got expired on December 2013. I had to resign and leave US on October 2013 for a personal reason. But, my H1B extension was filed by my previous employer before my resignation and the case was with USCIS. Now, I want to look for a job in US. Would the extension filed by previous company get cancelled since I resigned? If not, is there any benefit in getting the details(case number) from my prev company and inform the company I am going to seek the job? Please hep me here..

    Hi,

You need to have a valid H1b approved and Visa stamped on your passport to re-enter.

The extension petition wouldnt hold much significance if you are filing H1 with another employer.

How long were you in US on H1?

If you havent exhausted the entire 6 Years, any employer can file another cap exempt H1 petition (you would need to provide the first H1 approval notice and time spent in US details) and once the petition is approved, you can take that petition to the consulate, attend H1 stamping interview, and if approved and stamped, travel to US with the new petition and visa.

This is my opinion not legal advice.

        Hi,
I have spent just 1 year in US and its been one and half years since I got H1B . So, as per your response I hope I will have at least four and half years more to work in US with this current H1B. Thanks for the response.
