  • Fresh H1B ~~~~ Prem Processing

    I am going to apply from Fresh H1B Visa for the first time. I am currently working in the US with a different Visa.

    I am planning H1B using Premium processing(PP).

    Can someone please help me with:-

    1) What are the benefits of PP? Does it mean higher approval rate?

    2) For fresh H1B with PP - What is the Maximum response time (from the receipt of documents) from USCIS regarding H1B status - Approval, RFE , Denial etc?

    1. Apart from a faster response I dont see much benefit. As it is you can work on that H1 only from 01-Oct-2014 or later.
    2. Starting from the date when the quota fills up. Generally US master's quota premium processing get response first, then normal processing US master, then general quota premium processing then finally general quota normal processing. There is some delays if lottery is held. Normal quota premium processing result may be out by May/June 2014 if no RFE.

        Last year USCIS started premium processing only from April 15th 2013. http://www.uscis.gov/news/uscis-reac...-2014-h-1b-cap

        So, if something similar happens this year, you are looking somewhere around May 1st week to know of a decision if no RFEs. If RFE is raised the premium processing clock stops till the time you send the RFE response.
