  • h1 to f1

    is it possible to transition to a f1 visa without having to leave US?
    then after graduating can I go back to a new 6 years of h1 right away?

    H1 to F1 , yes possible. Fresh 6 Years of H1 without leaving US for 1 Year , not possible.

        There is no such rule that you need to be on H1 to apply PERM. You dont even need to be in US to file your perm provided your employer is willing to do so.

          so while being in F1 status one can apply for perm and get permanent residency on what ground, if not worker?

            Having a Green Card (officially known as a Permanent Resident


            In which category you planning to file ?

            If employment based, you anyhow are looking at 10-15 Years in EB2/Eb3 category.

              can perm (through work) can be filed directly from a F1 visa?

              also, is there a grace period after h1 expires? or I need to leave on the exact day it expires? can there be a gap of a month between h1 and f1?

                Perm is generally with respect to a future job, so yes, you can file it while on F1.

                As for out of status, the day your payroll stops you are out of status, there is no grace period allowed after that. Once out of status, it can be difficult to get a change of status to another status.
