  • H1b -I Got terminated on 13th Jan.. Searching for job aggressively.. Today is 6th feb

    Hi team,

    What are my options?

How do I know if the H1 is revoked?

If I find a new employer quickly, would they be able to file an H1 transfer even if it is revoked?
Do I let them use their own lawyers or use my lawyer?

Should I change status to B1/B2 and when i find employment will I be able to tranfer my H1 and start working immediately after applying?

I appreciate any help or suggessions you can provide.

    Thanks
    J

It doesn't matter whether H1 was revoked or not. The day you stopped getting paid, you are out of status. Once out of status it will not be possible to do a transfer or Change to another status.

This is my opinion not legal advice.

Talk to employer if they can keep you on bench while still running your payroll. Other than that you dont have much option but to leave US.

Also, if employer terminated you they are obligated to provide you return ticket or cash in lieu thereof.
