  • H1B Transfer within 1 to 2 month after landing to US .

    Hi ,
    I came to US on Company A , H1B in Jan2014, I got an offer from company B ..and they are ready for visa transfer. Is it safe to go for H1B visa transfer within 1 or 2 month of reaching to US? company A generate Pay stub monthly and I will have only one Pay stub (Jan Month) ? Can you please suggest if this should be ok?

    Hello, OWguru.

    Do check if the new company is ok to transfer with 1 Paystub. I had heard that companies take 3 paystubs to initiate visa transfer. I personally feel as long as you can prove that you maintained your H1B status, you are good to transfer.

    I know of someone who reached in September and filed for a transfer in January.

      thanks for your quick response. One more question.. i reached here in us on 10th Jan .. and my monthly pay stub is partial … for 15 days… starting from 15th Jan .. is it ok? or one should have job / joined the next day he landed in us?

        Hello, OWguru.

        I do not intend to scare you but one cannot be without H1B status (which actually gets decided by the payroll run by the employer) even for a day. If your H1B visa starts on or before the day you reached in USA, then the 5 days that you did not work could be viewed as being Out of Status by some.

        If possible, do take another opinion on this. There are Immigration Attorneys who you could engage for an hour long consultation. They charge something like 100 Dollars for an hour.
