I'm currently on F1-OPT and my OPT ends 5/19 this year. I'm working in a non-profit and my employer has filed H-1B petition for me (cap-exempt). The petition has been approved and the start date is 5/20 (after my OPT ends). My question is: Can I change for a for-profit before 4/1 this year, assuming that the new employer is willing to also file H1b for me? Specifically:
1. If the new employer files H1b on 4/1 this year (subjected to the cap) and assuming it is approved: can I start working for the new employer immediately or even before 4/1, say next month (i.e. can still use the cap-gap for my OPT) or do I have to wait until 10/1?
2. If the new employer is e-verified, can I change to the new employer and still apply for OPT STEM extension (I'm in STEM major), and wait till next year to apply for H1b?
Thank you very much.
