I have an expired (2008 CAP) H1 petition which i never used , later i come US on L1 B in 2010 , converted L1 A 2012 September now my visa expiring soon (2014 September)
now can i use my my old H1 petition to file petition ? my 2008 CAP is still valid ?

Not a straight forward case. You may still be able to use it. Talk to an attorney.
