  • H1 status after leaving US

    I got my H1 in 2008 and travelled to US in 2009. My H1 was sponsored by Wipro. I moved out of Wipro in 2011 and joined Hexaware for 1 and half year. I re-joined Wipro in 2013. I resigned from Wipro and moved back to India in Jan 2014. I have joined another company in India. My H1 stamping was only till March 2013. Going by my start date I still had another 2 years remaining in my H1 when I resigned from Wipro.

    Now my current company is looking at senidng me onshore. I would like to know if my old H1 is still valid and can be transferred if needed.

    Hello, Mgkganesh.

    As you have not used all 6 years on your H1B, you are eligible to recapture the remaining visa period. Your current employer needs to file a cap-exempt petition and you will be able to use the balance period on your H1B. Also, you need not wait till April, you can file any time.
