    Hi All,

    I want to know if my petition get approved but i dont go for stamping. What is the eligible time frame for me to get it stamped with that particular employer or get it transfered to another employer and stamp it ( considering any time in year and not like only march/april).

    Sorry , very new to this process so it might be a stupid question.

    If it s a fresh petition, anyhow, the earliest you can go for stamping would be 60 Days prior to employment start date which cannot be earlier than 01-Oct-2014, so 60 days before that would be around August 1st 2014.

    Now technically you can for interview until the petition end date as long as you have the latest employment/client letter with you during the interview. Example, it would be difficult to convince the officer in say June 2015 about an offer on employment which was to start in Oct 2014 unless you have a May/June 2015 appointment letter. Also if the client letter is also old it would be difficult.

      Actually my question was moreover toward the validity of petition , if i don't go for stamping with fresh petition approved , do i have the option in next coming years ( how many years validity ?) where i can find another sponsor who is ready to transfer my petition and provide employement ? or i need to go for another fresh petition again ?

        Once cap counted you would be cap exempt for next 6 Years. Each employer would have to file a separate petition, but the petition itself would be cap exempt for 6 Years.
