Hi,
My H1 petition was approved in 2007 while I was in US on a H4. I worked in the US from Oct 2007 to Nov 2008.
In Dec 2008, I came back to India and got my visa stamped but I didn’t return back to the US after that. I have been working in India since then. Can I apply for an H1 visa under the CAP exempt quota.
