Can I apply for H1B with COS from H4?

Hi,

My spouse work for company A on H1B. I got my H4 approval today i.e 2/25/2014. Now My wife just transferred her H1 from company A to Company B. Her Transfer petition have been approved today, i.e. on 2/25/2014. Now My H4 is filed when my spouse was with Company A. Now I have the below questions.

My Questions:

1. Do I need to transfer my H4?
2. If I want to apply for H1B for this year, Can I apply for COS?

Please suggest me on the next steps.

1. No need as long as you have a valid I-94 for next 6 Months or more.
2. Yes as long as you have an I-94 stretching beyond 01-Oct-2014.
