  • What does H1 transfer filing mean and what is receipt notice?

    Hi,

I am employed with company A and company B initiated my H1 transfer paper works and mailed to USCIS. The mailing date was when my I 94 was valid but by the time when it reached USCIS, my I-94 expired. So where would my H1 transfer filing date fall? When I94 is valid or I94 is expired? What is filing really mean? Is there any chance my H1 transfer be rejected based on filing date assuming all papers are good? Appreciate your information.

    Thanks

Why did you file at the nth moment when USCIS allows up to 6 Months advance to file it? If not week, one should always keep few extra days handy.

If receipt date is post your I-94 expiry date then yes it is possible USCIS may reject the extension decision or approve it as consular notification.

This is my opinion not legal advice.

Ya my bad but luckily I have initiated extension with my company A in regular mode. Though I didnt share those details when H1 transfer filing with company B. Reason being, company A didn't share receipt # of extension.

Still do you see any chances of smooth approval as I am still in valid status because of my extension filing?

Let me clarify myself on some of the questions i had.

What could be H1 transfer filing date? (or any visa with USCIS)
It's the date when USCIS collects the case mails from its PO box. Remember, its not the date it reaches PO box but its the date when USCIS collects. However, they do it several times in a day.
