I have an unused H1B petition (2013 cap) which is valid until Oct 2016. Since my sponsor could not get me the right opportunity to work in US I had to cancel my H1 and travel on H4. Now I have got an opportunity to work here. Can my new employer do a H1B transfer for me to be able to work in US? My current visa status is H4. I797 is valid until 2016.
