New I-94 after in I797 after extension approved
Hi,
1. I was in US and My I-94 and H1-B petition got expired on 31st Dec 2013, But before the expiration extension was applied on 4th December.
2. I was in US, when the extension petition was pending. Finally it got approved on 12th Feb 2014.
3. In the new I797 which i got after extension approval contains a new I-94 for which the validity date mentioned is 12th Feb 2014 to 7th July 2014.
So My question the time that I stayed here from 1st Jan 2014 to 11th Feb 2014 is valid or not. Is there any consequence. I know we can stay upto 240 days after I94 expires but a timely extension was applied before I-94 expired and the decision is pending.
Please clarify the question If you are familiar with this kind of situation.
