Reg - I-94 Extension

Hi ,

I am Vetrivelkumar . I am in L1 Visa . My I-94 has expired on 11-Jul-2005.

My Employer has applied for my I-94 Extension. But Still I am not receive the

Receipt Number itself. Now I want to go to India urgently. My Employer says

no problem come back and they(Employer) have told me that they are going

to file new petition for me. If I leave from US in this stage, Will it affect me

(I mean Will INS consider as OverStay ?) Please advise me.

They should not need to file new petition.

Make sure they really have filed petition for you before July 11, 2005. Otherwise, you are out of status already.

If they have filed a petition, you would need the receipt of that to come back to US.
