    Dear Immihelp,

    I have a big doubt regarding L1 B and valid H1 B visa. My question is that, I was working with one of the Indian MNC since 2009 in US on L1 B visa. Last year I applied for H1 B through some other XYZ company and I got my name on 2013 H1 lottery. I am still working on L1 B visa with Indian MNC and now I have an offer from some other ABC company and wanna join that.
    Some one told me that its illegal to work on L1 till date if you got your H1 in Oct 2013. Please help me to know what are the consequences and legal restriction to have both visa and working on L1 B visa only.

    Was H1 approved as Consular process or COS. Did the approval came with new I94?

      H1 was approved as a consular process but my new company (which processed my H1) says it will be change of status.

        If it was approved as consular process initially you are still fine to currently work with L1 employer.

        But in future if the Change of Status to H1 is approved with the new employer then you must work with new employer from COS effective date.

        This is my opinion not legal advice.
