  • Quick help needed Please - H4 to H1 filing

    Hi,

    I came to US on 6th Oct 2013 on H4 visa. I have 3 years of working experience in India. Recently I got an offer from one of the consultant company which will file my H1B.

    Here are some of my doubts which I need help upon. That would be really helpful to me as very little has left.

    1. I have been offered premium processing and they are charging me around 4k (1K Lawyer non refundable + 3K visa fee refundable). So is it worth?
    2. When should I make the payment. Is it good if I do before the approval of LCA or payment should be done after submitting the documents and LCA approval.
    3. What proof should I get stating that I have made the payment to avoid any kind of fraud.
    3. Is that ok to sign a contract as I have been asked to sign a contract of 1.5 yrs.
    4. I won't be getting any medical benefits anytime. Is it genuine?

    Please I need urgent help on this. I will really appreciate that.

    Its illegal to pay for your own H1. You are opening yourself to fraud by agreeing to this. If at all the "employer" back tracks later on you hardly have any legal recourse.
    1. I dont understand what you mean when you say " is it worth it".
    2. As said, its wrong to pay for ones own H1.
    3. Paying for ones own H1 itself is a fraud.
    3&4. Again, it depends upon the employer.
