  • H1b Notice of Intent Revoke (NOIR)

    Hi All-
    I got my h1b approval to start working on Oct 1 2013. The project didnt start immediately as intended and i started looking for new projects. My employer has been running my pay role. I recently for a Job offer with a client to start working in 2 weeks. In the mean while my employer also received a mail Notice of Intent revoke couple of days back.

    This notice is about client document not being submitted at the time of applying the H1b petiton and there was an error in approving the H1b petition.

    Now I have a job to join and this notice at the right point of time. My employer is discussing with my attorney with the best course of action to be taken.
    I still wanted to post this to get some more information and details to speak to my employer about it in detail

    Any help is much appreciated.. Thank you!

      An approved immigrant visa petition may be revoked by a U. S. Citizenship and Immigration Services (USCIS) officer authorized to approve such petitions.Reasons for Revocation


      In other instances, the approval of an immigrant visa petition may be revoked upon notice ("revocation on notice") by issuing a Notice of Intent to Revoke (NOIR) to the petitioner. See 8 CFR 205.2. The NOIR will explain the reasons the approved petition should be revoked and will give the petitioner a reasonable period of time to submit evidence to show why the petition should not be revoked. The petitioner must respond within the time allotted. An extension may be granted at the discretion of USCIS if the petitioner needs additional time to obtain documentation from abroad or for other meritorious reasons; however, the petitioner must respond in a timely manner to the NOIR by the stated deadline, and provide a reason for requesting the extra time.

      You cannot do a transfer to another employer till it is resolved.
