This is my first post on this site, I require some information. I am currently in US on an assignment for my Indian Employer. Am here on an L1 visa. In 2001 another company from US applied for an H1B visa which was subsequently approved. But after that the company went out of business and that offer did not materialise and they didnt send me the I 797.
Now in the current scenario I want to change jobs and for that I will require a H1 visa as L1 cannot be transferred.
Does anyone knows whether it is possible to invoke that earlier H1 petition which was approved in 2001 and my future employer can use that H1 to employ me and doesnt need a fresh application, that way the cap on H1 will not matter.
If anyone has any information on this and can share it here it will be of great help.
